Stay on Plant Limits for Medical Growers Transitioning to OLCC

In order to be eligible for the stay on plant limits, a medical marijuana grower must do the following:

  • Have submitted a producer application to the OLCC on or before April 1, 2016.
  • Send notice of intent to hold an OLCC production license using the form letter found on the OMMP website to each patient for whom marijuana is being produced at the grow site address.
      • Submit the following to the OMMP:
    1. Proof that the applicant has sent notice, by certified mail with return receipt request, to each patient.
    2. Stay of Plant Limits Notification form.
    3. A statement that the medical grower has filed a completed application with the OLCC, including the date submitted, to produce marijuana at the medical marijuana grow site address. Grandfathered Grow Site Pet​​iti​on

Medical marijuana grow sites may request to grandfather grow site limits by submitting a petition to OHA.

  • Every grower must have maintained continuous status as a grower at the grow site address since December 31, 2014.
  • Only approved growers may produce marijuana at the grow site.
  • A grow site must have a physical address within Oregon.
  • A grow site cannot be a dispensary or an OLCC grow site.
  • If the grandfathering petition is granted, a grower may grow for no more than the number of patients the grower had at the grow site on December 31, 2014.
NOTE

You should submit a grandfathering petition ONLY if you are petitioning the OMMP to grow more marijuana plants than what is allowed under HB 3400.

Under HB 3400, a grower can have 6 plants per patient. Plant limits are as follows:​​

12 mature plants if the location is within city limits and zoned residential

-- OR --

48 mature plants if the location is within city limits but not zoned residential, or not within city limits

If you do not plan to grow more than this number of marijuana plants, you should not submit a grandfathering petition.​
