Proposed rules allowing a hospital to have an off campus emergency department within 35 miles of the parent hospital and rules allowing a hospital satellite to offer psychiatric services that includes both inpatient psychiatric services and emergency psychiatric services have been finalized and are effective August 13, 2015.
"Hospital Satellite Providing Emergency Psychiatric Services”
In February 2015, the OHA filed temporary administrative rules with a minor change to existing rules allowing a hospital satellite to offer psychiatric services that includes both inpatient psychiatric services and emergency psychiatric services in order to allow a hospital or health system more flexibility in providing psychiatric emergency services in a more efficient and patient centered way, and possibly reduce the number of psychiatric patients waiting for care in an emergency department. The rules clarify OHA’s intent that these services need to comply with federal Emergency Medical Treatment and Labor Act (EMTALA) regulations, all hospital licensing administrative rules, and that emergency psychiatric services must be offered in an emergency department. A hospital proposing to offer such services must provide evidence that the facility is not subject to Certificate of Need requirements in ORS 442.315.
"Hospital Satellite Emergency Departments"
In March 2015, the OHA filed temporary administrative rules in response to the needs of communities in rural Oregon where hospital based emergency services can be sought more quickly than traveling upwards of 30 minutes to seek care. The rules revise the definition of satellite and permit a hospital to have an off campus emergency department within 35 miles of the parent hospital, under the hospital’s license if it meets specified criteria and data reporting. A parent hospital will be required to provide evidence that it can meet specified criteria for patient safety, must provide emergency medical services in accordance with requirements for hospital-based emergency departments, and may not be located in an area where such services would undermine existing hospitals systems.
